Fighting A Speeding Ticket That You Feel You Didn't Deserve

Have you have even been stopped for speeding and receive a ticket that you feel you didn't deserve? It can happen and depending on the circumstances of the stop, you may have a case. If you do decide to fight the citation, you may want to consider getting some help before you take on the officer in court.

Hiring An Attorney

If you are heading to court to fight the ticket you received, it is a good idea to hire an attorney that specializes in traffic offenses. The tactics used in these cases are different than that in many other legal proceedings. The lawyer will know how to best approach the case and what details need to be brought out to prove that the ticket was not warranted. Talk with the lawyer and see what information they need from you beforehand so that you are not on the same page. 

Noting Traffic Conditions

One thing you really want to make a note of at the time of the offense is the traffic conditions where you were stopped. If you were in a large pack of cars, the police officer may not have really been able to determine which car his radar actually picked up. Your lawyer will want to know that information because he will more than likely use that in court. Remember, fighting a ticket is not about proving you didn't do it; it is about planting doubt in the mind of the judge or jury. You do not want to try and make the police officer seem like they were targeting you, just that they could not have been sure it was your car that was clocked speeding.

Be Prepared To Pay The Fine

While you may very well win your case, it is a good idea to be prepared to pay the fine in case you lose. The judge may agree with you but if the rules with the officer, it is better to pay the fine right away so that no further action is taken. Failure to pay the fine is a jailable offense in many states, so it is better to not take a chance. You will need to pay your lawyer as well, but most of the time they will work with you on the payments. If you have a deal with the attorney to not pay any fees if you lose your case, then you only need to worry about paying the fine to the court.
